New French law requires certified breathalyzer in all motor vehicles | 02:59 PM GMT, July 11, 2012

Beginning July 1, 2012, French law requires all drivers to carry a Norme Francaise (NF) certified breathalyzer in their motor vehicle. CWT travelers should be aware that the law applies to all drivers regardless of nationality and includes rental cars.

According to the law, the breathalyzer can be chemical or electronic and must meet the standards set forth by the NF. Additionally, if the device is chemical, it must be unexpired and must not have been used previously. The chemical breath test is valid for two years with its expiration date printed on the original package.

The absence of a certified breathalyzer is punishable by fine in the amount of 11€. If it is not paid within five days, the fine increases to 90€.

CWT Global Supplier Management has been able to confirm with most ground transportation rental suppliers that certified devices will be provided and available in rental cars. However, it is the responsibility of the traveler to ensure a device is present and that it is not expired. In the event the driver does not have an approved device in the vehicle when stopped by police, the rental provider can not be held responsible.

CWT travelers renting motor vehicles in France are encouraged to verify a certified device is in the rental car prior to leaving the supplier’s facility. If one is not present, notify a rental company contact prior to leaving. Additionally, if used, the traveler is responsible for replacing the device prior to rental contract expiration.

While the law is currently in effect, there will be a limited grace period through November 1, 2012, when it will become mandatory.

CWT will continue to monitor the situation as appropriate and provide additional information from the French government as it becomes available.
